As expected, they have moved to dismiss, more or less on the grounds I surmised earlier. The claim about publication of private facts will almost certainly be dismissed, given the arguments in the motion. On the defamation claim, I was surprised that defendants relied so heavily on the claim that the book represents "opinion" based on truthful facts; although the defamation claim may face problems related to its pleading, I'm not persuaded by the "opinion" defense. The intentional infliction of emotional distress claim will almost certainly be dismissed, as well.
